{"id":1153,"date":"2013-05-22T03:20:45","date_gmt":"2013-05-22T03:20:45","guid":{"rendered":"http:\/\/suretyone.com\/blog\/?p=1153"},"modified":"2020-12-02T05:00:29","modified_gmt":"2020-12-02T05:00:29","slug":"texas-motor-fuel-tax-bond","status":"publish","type":"post","link":"https:\/\/suretyone.com\/blog\/texas-motor-fuel-tax-bond\/","title":{"rendered":"Texas Motor Fuel Tax Bond"},"content":{"rendered":"<p>The Comptroller determines the amount of the <a href=\"https:\/\/suretyone.com\/texas-motor-fuel-tax-bonds\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Texas motor fuel tax bond<\/strong> <\/a>required of a supplier, permissive supplier, distributor, exporter, importer, or blender that operate(s) within the state. \u00a0Each of the six classes of permit require this type of security. \u00a0When fixing the <strong>Texas motor fuels tax bond<\/strong> penalty (sum) the Comptroller must consider\u00a0the amount of fuel tax that has or is expected to become due from the applicant, any past payment history of the applicant as a licensee, and the necessity to protect the state against failure to pay fuel taxes as they become due. \u00a0Pursuant to TX\u00a0<a title=\"TX motor fuel tax laws\" href=\"http:\/\/www.statutes.legis.state.tx.us\/Docs\/TX\/htm\/TX.162.htm\" target=\"_blank\" rel=\"noopener noreferrer\">Sec. 162.111(b)<\/a>, a licensee\u00a0must post a bond equal to two times the maximum amount of tax that could accrue on tax-free gasoline purchased or acquired during a reporting period. The minimum <strong>Texas motor fuels tax bond<\/strong> is $30,000, and the maximum $600,000 unless the <a title=\"TX Comptroller\" href=\"http:\/\/www.window.state.tx.us\/taxinfo\/taxforms\/06-forms.html\" target=\"_blank\" rel=\"noopener noreferrer\">Comptroller<\/a> believes there is undue risk of loss of tax revenues, in which event the comptroller may require one or more bonds or securities in a total amount exceeding the $600,000 threshold. \u00a0There is a provision in the statute that allows a licensee to request a release of the surety bond, but only after reaching\u00a0four consecutive years of continuous compliance with the conditions of the surety bond. If the Comptroller determines that the state&#8217;s position would be jeopardized by a release of the <strong>Texas motor fuels tax bond<\/strong> then the Comptroller may choose NOT to release the bond AND may reimpose a requirement of bonding as he determines necessary.<\/p>\n<p>The surety bond must be written as a continuing instrument, and like many <strong>Texas Comptroller bonds<\/strong>,\u00a0it is cumulative so each bond renewal represents a new and separate obligation in the penal sum named in the surety bond for each calendar year that the bond is in force. \u00a0The surety remains liable until the Comptroller chooses to release the <strong><a title=\"Surety One commercial surety page\" href=\"https:\/\/suretyone.com\/commercial-surety-bonds\" target=\"_blank\" rel=\"noopener noreferrer\">Texas motor fuel tax bond<\/a><\/strong>, which\u00a0may not be released until it is determined by examination or audit that a tax, penalty, or interest liability is not due the state. \u00a0While the body of the obligation does not include a cancellation provision,\u00a0<a title=\"TX motor fuel tax laws\" href=\"http:\/\/www.statutes.legis.state.tx.us\/Docs\/TX\/htm\/TX.162.htm\" target=\"_blank\" rel=\"noopener noreferrer\">Sec. 162.111(i)<\/a>\u00a0does allow it. \u00a0A surety must\u00a0be released and discharged from liability accruing on the instrument on the 31st day after the date on which the surety files with the comptroller a written request to be released and discharged on the <strong>Texas motor fuel tax bond<\/strong>.
