{"id":1187,"date":"2013-06-03T02:38:49","date_gmt":"2013-06-03T02:38:49","guid":{"rendered":"http:\/\/suretyone.com\/blog\/?p=1187"},"modified":"2017-01-03T16:20:33","modified_gmt":"2017-01-03T16:20:33","slug":"california-employment-agency-bond","status":"publish","type":"post","link":"https:\/\/suretyone.com\/blog\/california-employment-agency-bond\/","title":{"rendered":"California Employment Agency Bond"},"content":{"rendered":"<p>California Civil Code requires the posting of a <strong><a title=\"Surety One\" href=\"https:\/\/suretyone.com\" target=\"_blank\">California employment agency bond<\/a><\/strong> by all private employment services subject to <a title=\"CA Empl Agcy laws\" href=\"http:\/\/www.leginfo.ca.gov\/cgi-bin\/displaycode?section=civ&amp;group=01001-02000&amp;file=1812.503-1812.5095\" target=\"_blank\">Title 1812.500<\/a>\u00a0and its subsections. \u00a0The statute defines &#8220;employment agency&#8221; as any person who, for a fee or other valuable consideration to be paid by a jobseeker, performs, offers to perform any of the following services: (i) Procures, offers, promises, or attempts to procure employment or engagements for others or employees for employers. \u00a0(ii) Registers persons seeking to procure or retain employment. \u00a0(iii) Gives information as to where and from whom this help, employment, or engagement may be procured. \u00a0(iv) Provides employment or engagements. \u00a0The <strong>California employment agency bond<\/strong> is also required of any person who collects dues, tuition, or membership or registration fees of any sort, if the main object of the person paying those fees is to secure employment. \u00a0Lastly, any person who, for a fee or other valuable consideration, procures, offers, promises, provides, or attempts to procure babysitting or domestic employment for others or domestics or babysitters for others must also provide a <strong><a title=\"CA Empl Agcy surety bond form\" href=\"http:\/\/www.sos.ca.gov\/business\/sf\/forms\/sf-sb-449.pdf\" target=\"_blank\">California employment agency bond<\/a><\/strong>. \u00a0The surety bond must run be written in the amount of three thousand dollaras and run to the People of the State of California, by the\u00a0<a title=\"CA Secy of State\" href=\"http:\/\/www.sos.ca.gov\/business\/sf\/forms.htm\" target=\"_blank\">California Secretary of State<\/a>. \u00a0The surety must be admitted to do business in the state and the bond conditioned that the person providing the surety bond will comply with the Act and will pay all sums due any individual or group of individuals when the employment agency has received said funds. The <strong>California employment agency bond\u00a0<\/strong>is for the benefit of any person or persons damaged by any violation of Title 1812.500, or by fraud, dishonesty, misstatement, misrepresentation, deceit, unlawful acts or omissions, or failure to provide the services contracted for with a jobseeker. \u00a0The surety may cancel the obligation however thirty days prior to the cancellation the surety must send a written notice of the intent to cancel the <strong><a title=\"Surety One commercial surety page\" href=\"https:\/\/suretyone.com\/commercial-surety-bonds\" target=\"_blank\">California employment agency bond<\/a><\/strong> to both the employment agency and the Secretary of State, identifying the surety bond and the cancellation date. \u00a0By its very wording the surety bond is not cumulative. \u00a0Very special claims procedures are contained in the statute as are the multiple responsibilities of an employment agency. \u00a0A thorough reading of <a title=\"CA empl. agcy laws\" href=\"http:\/\/www.leginfo.ca.gov\/cgi-bin\/displaycode?section=civ&amp;group=01001-02000&amp;file=1812.503-1812.5095\" target=\"_blank\">\u00a71812.504<\/a>\u00a0is necessary in order to adequately understand the nature of this obligation and how claims against the <strong>California employment agency bond\u00a0<\/strong>are processed by the Secretary of State&#8217;s office. \u00a0The surety bond form also guarantees the surety&#8217;s compliance with Chapter 2 (commencing with Section 995.010), Title 14, Part 2 of the Code of Civil Procedure.<\/p>\n<p><strong>California surety leader<\/strong>,\u00a0<a title=\"Surety One\" href=\"https:\/\/suretyone.com\/\" target=\"_blank\">Surety One, Inc.<\/a>, is the most agile and responsive surety underwriter in the United States. \u00a0We offer private employment agency\u00a0bonds\u00a0to ALL applicants in every where they are required by law.
