{"id":1210,"date":"2013-06-09T04:06:42","date_gmt":"2013-06-09T04:06:42","guid":{"rendered":"http:\/\/suretyone.com\/blog\/?p=1210"},"modified":"2017-06-17T23:25:00","modified_gmt":"2017-06-17T23:25:00","slug":"washington-supersedeas-bond","status":"publish","type":"post","link":"https:\/\/suretyone.com\/blog\/washington-supersedeas-bond\/","title":{"rendered":"Washington Supersedeas Bond"},"content":{"rendered":"<p>Generally, a trial court decision\u00a0may be enforced pending appeal or review unless a <strong>Washington supersedeas bond<\/strong> is posted and the execution stayed pursuant to the provisions of the Rules of Civil Procedure (<a title=\"WA supersedeas rules\" href=\"http:\/\/www.courts.wa.gov\/court_rules\/?fa=court_rules.display&amp;group=app&amp;set=RAP&amp;ruleid=apprap08.1\" target=\"_blank\" rel=\"noopener noreferrer\">RAP 8.1<\/a>). \u00a0Any party to a review proceeding has the right to stay enforcement of a money judgment or a decision affecting real, personal or intellectual property, pending review however the stay of a decision in other civil cases is a matter of discretion. \u00a0The amount of the <strong>Washington supersedeas bond\u00a0<\/strong>required depends on the underlying decision, as follows:<\/p>\n<p>(1) Money Judgment. The supersedeas amount shall be the amount of the \u00a0judgment, plus interest likely to accrue during the pendency of the appeal and\u00a0attorney fees, costs, and expenses likely to be awarded on appeal.<\/p>\n<p>(2) Decision Affecting Property. The <strong>Washington supersedeas bond<\/strong> amount must be at least equal to the\u00a0amount of any money judgment, plus interest likely to accrue during the\u00a0pendency of appeal and attorney fees, costs and expenses likely to be awarded\u00a0on appeal entered by the trial court plus the amount of the loss which the\u00a0prevailing party in the trial court would incur as a result of the party&#8217;s\u00a0inability to enforce the judgment during review. Ordinarily, the amount of\u00a0loss will be equal to the reasonable value of the use of the property during the\u00a0review.<\/p>\n<p>(3) If a party seeks to stay enforcement of only PART of a judgment then the <strong>Washington supersedeas bond<\/strong> amount will be set at an amount that the trial court determines is appropriate to secure that portion of the judgment, plus interest likely to accrue during the pendency of the appeal and attorney fees, costs, and expenses likely to be awarded on appeal.<\/p>\n<p>Upon the filing of a supersedeas bond,\u00a0pursuant to subsection (b)(4) of RAP 8.1, enforcement of a\u00a0trial court decision against the party furnishing the bond, cash or alternate\u00a0is stayed.
