{"id":1265,"date":"2013-06-23T05:08:47","date_gmt":"2013-06-23T05:08:47","guid":{"rendered":"http:\/\/suretyone.com\/blog\/?p=1265"},"modified":"2017-01-03T16:20:33","modified_gmt":"2017-01-03T16:20:33","slug":"maryland-employment-agency-bond","status":"publish","type":"post","link":"https:\/\/suretyone.com\/blog\/maryland-employment-agency-bond\/","title":{"rendered":"Maryland Employment Agency Bond"},"content":{"rendered":"<p>State law requires a <strong><a title=\"Surety One\" href=\"https:\/\/suretyone.com\" target=\"_blank\">Maryland employment agency bond<\/a>\u00a0<\/strong>from any party engaging in private employment placement within the state. \u00a0An &#8220;employment agency&#8221; is a person, partnership or corporation which, for a fee: (1) an employee for a person who seeks an employee, or, (2) employment for clients; or (b) provides a client with information to enable the client to obtain employment; (c) obtains, offers to obtain, or attempts to obtain employment or an engagement in connection with an entertainment, exhibition, or performance. \u00a0Licensing and the <strong>Maryland employment agency bond<\/strong> is also required for parties that obtain, offer to obtain, or attempt to obtain an alien labor certification or immigrant visa for an individual, and participates directly or indirectly in the recruitment or supply of an individual who resides outside of the continental United States for employment in the continental United States. \u00a0In 2008, the Employment Agencies Law was amended by the Maryland General Assembly to give the <a title=\"MD COmm of Labor\" href=\"http:\/\/www.dllr.state.md.us\/labor\/wages\/empa.shtml\" target=\"_blank\">Commissioner of Labor and Industry<\/a> (\u201cCommissioner\u201d) authority to ensure compliance with the <strong><a title=\"MD Employment agency state bond form\" href=\"http:\/\/www.dllr.state.md.us\/forms\/empagbondform.pdf\" target=\"_blank\">Maryland employment agency bond<\/a><\/strong> requirement of\u00a0<a href=\"http:\/\/mlis.state.md.us\/asp\/statutes_respond.asp?article=gbr&amp;section=9-301&amp;Extension=HTML\">Section 9-301(a) &amp; (b)<\/a>,\u00a0<em>Business Regulation Article, Annotated Code of Maryland<\/em>, receiving from each employment agency a bond written in the amount of $7000. \u00a0The surety bond is a compliance and indemnity obligation. \u00a0The form guarantees that the licensee will comply with the provision of Title 9 of the Business Regulation Article and pay all damages caused any person by reason of any misstatement, misrepresentation, fraud, or deceit forbidden by law on the part of such licensee or of his agents or employees. \u00a0The <strong><a title=\"Surety One commercial surety page\" href=\"https:\/\/suretyone.com\/commercial-surety-bonds\" target=\"_blank\">Maryland employment agency bond<\/a><\/strong> contains no cancellation provision nor does it contain term limiting language, suggesting that release may be difficult and cumulative liability a concern. \u00a0Surety experience however has been favorable with this particular obligation.<\/p>\n<p>Further information and forms can be obtained from the Commissioner as follows:<\/p>\n<p><strong>Maryland Department of Labor, Licensing and Regulation<br \/>\nDivision of Labor and Industry, Maryland Employment Agency Bond<\/strong><br \/>\n1100 North Eutaw Street<br \/>\nRoom 606<br \/>\nBaltimore, MD\u00a0 21201<br \/>\nTelephone Number: (410) 767-2241<br \/>\nFax Number: (410) 767-2986<br \/>\nE-mail Address:\u00a0<a href=\"mailto:dli@dllr.state.md.us\">dli@dllr.state.md.us<\/a><\/p>\n<p><strong>National\u00a0surety leader<\/strong>,\u00a0<a title=\"Surety One\" href=\"https:\/\/suretyone.com\" target=\"_blank\">Surety One, Inc.<\/a>\u00a0is the \u2018No. 1\u2032 underwriter of surety bonds for the financial services sector. \u00a0We offer private employment agency\u00a0bonds\u00a0to ALL applicants in every jurisdiction that requires them.
