The state legislature&#8217;s purpose was to create\u00a0an oversightsystem\u00a0for appraisal managers. The house committee&#8217;s stated, &#8220;In most residential real estate transactions, the lender must\u00a0have an independent appraisal of the property to ensure an accurate, objective valuation. An AMC\u00a0is often the entity that provides this independence, contracting with an appraiser to perform the\u00a0appraisal. Without this legislation in place by December of 2018, lenders in federally-related\u00a0residential real estate transactions such as the Veteran&#8217;s Administration, Fannie Mae and others,\u00a0will not be able to use most AMC&#8217;s. This could result in disruption and delays to consumers,\u00a0realtors, appraisers and lenders in residential real estate loan transactions.&#8221; Idaho is one of the last states to pass licensing or registration requirements for these enterprises.<\/p>\n<p>The law states that an applicant for issuance or renewal of an appraisal management\u00a0company registration is required to file with the Real Estate Appraiser Board an Idaho appraisal management company surety bond\u00a0with a\u00a0corporate surety authorized to do business in Idaho.\u00a0The Idaho appraisal management company surety bond must be written in the amount of\u00a0twenty-five thousand dollars ($25,000).\u00a0The obligation is that payment(s) shall be made for\u00a0all amounts adjudged by a court\u00a0of competent jurisdiction owed\u00a0to persons that have been injured\u00a0by the appraisal management company&#8217;s failure to comply with this\u00a0state laws.\u00a0The name of the corporate surety and bond\u00a0number\u00a0must be given\u00a0to persons or their insurers who provide written evidence to the Board that they possess an adjudicated and unsatisfied judgment against\u00a0the AMC.\u00a0The Board\u00a0can demand a copy of any surety bond(s) in effect\u00a0upon written\u00a0request of the same.\u00a0A person or the Board may bring suit against the <a href=\"https:\/\/suretyone.com\/commercial-surety-bonds\" target=\"_blank\">surety bond<\/a>. An\u00a0action against the surety bond must be commenced within\u00a0one hundred twenty (120) days after the appraisal management company\u00a0failed to comply with regulations.<\/p>\n<p>The surety bond wording and format is presumably being drafted.
