{"id":1705,"date":"2016-07-17T23:30:56","date_gmt":"2016-07-17T23:30:56","guid":{"rendered":"http:\/\/suretyone.com\/blog\/?p=1705"},"modified":"2017-01-03T16:20:28","modified_gmt":"2017-01-03T16:20:28","slug":"fianza-de-hostelero","status":"publish","type":"post","link":"https:\/\/suretyone.com\/blog\/fianza-de-hostelero\/","title":{"rendered":"Fianza de Hostelero"},"content":{"rendered":"<p>La \u201cLey 272\u201d\u00a0de Puerto Rico\u00a0establece que los due\u00f1os de las propiedades de alojamiento uplementario a\u00a0&#8220;corto Plazo&#8221; cobran\u00a0un impuesto igual a un\u00a0siete por ciento (7%) del costo de la habitaci\u00f3n por concepto del &#8220;Impuesto\u00a0sobre el Canon por Ocupaci\u00f3n de Habitaci\u00f3n&#8221;. El impuesto se remite\u00a0a la Compa\u00f1\u00eda de\u00a0Turismo de Puerto Rico. \u00bfQu\u00e9 es una propiedad alquilada a corto plazo? La Division de Impuestos de la CTPR\u00a0define tales propiedades como\u00a0aquellas que se alquilan por un per\u00edodo menor a\u00a0noventa (90) d\u00edas consecutivos.\u00a0El Canon exige la facturaci\u00f3n por\u00a0hostelero por la ocupaci\u00f3n de cualquier\u00a0habitaci\u00f3n de una hospeder\u00eda\u00a0o\u00a0due\u00f1os de propiedades de alquiler\u00a0privados, incluyendo valores recibidos en especie y &#8220;fees&#8221; adicionales.\u00a0Los due\u00f1os de estas propiedades deben registrarse y solicitar su N\u00famero de\u00a0Identificaci\u00f3n en la Divisi\u00f3n de Impuestos de Habitaci\u00f3n y proveer una <strong>fianza de hostelero<\/strong>. Tambi\u00e9n se puede tramitar tal registro por\u00a0Internet\u00a0a\u00a0www.seepuertorico.com.\u00a0Una vez haya completado la solicitud de registro, deben someter la misma a Departmento por correo o fax. Para mas informaci\u00f3n o para radicar documentos se puede comunicar con la Compa\u00f1\u00eda por:<\/p>\n<p>(787) 721-3183\u00a0(fax)<br \/>\nroomtaxpr@tourism.pr.gov<br \/>\nCompa\u00f1\u00eda de Turismo de Puerto Rico<br \/>\nDivisi\u00f3n de Impuestos de Habitaci\u00f3n<br \/>\nPO Box 9024000<br \/>\nSan Juan, PR 00902-4000<\/p>\n<p>Seg\u00fan la Compa\u00f1\u00eda de Turismo, &#8220;todo hostelero deber\u00e1 prestar una fianza de hostelero para garantizar el pago a tiempo del impuesto y de cualesquiera recargos, intereses, penalidades o multas administrativas que se le impongan\u00a0a \u00e9ste a causa de\u00a0violaciones a las disposiciones de la\u00a0Ley y\/o sus Reglamentos.\u00a0La penalidad (valor) de la fianza\u00a0ser\u00e1 por la cantidad y de\u00a0acuerdo con los t\u00e9rminos y condiciones que fije la Compa\u00f1\u00eda mediante\u00a0reglamentaci\u00f3n aprobada al efecto. Dicha fianza puede\u00a0ser prestada ante la\u00a0Compa\u00f1\u00eda a trav\u00e9s de una compa\u00f1\u00eda\u00a0debidamente autorizada para prestar fianzas, conforme a las leyes del Estado\u00a0Libre Asociado de Puerto Rico.&#8221;\u00a0La omisi\u00f3n o incumplimiento del requisto de\u00a0la fianza conlleva\u00a0una multa de quinientos d\u00f3lares<br \/>\n($500.00) mensuales. La compa\u00f1\u00eda afianzadora puede cancelar la fianza, notificando a la Compa\u00f1\u00eda con treinta d\u00edas de antelaci\u00f3n.
