Under the Arizona Revised Statutes, Rules of Appellate Procedure (<a href=\"https:\/\/govt.westlaw.com\/azrules\/Document\/N1B05C510717B11DAA16E8D4AC7636430?viewType=FullText&amp;originationContext=documenttoc&amp;transitionType=StatuteNavigator&amp;contextData=(sc.Default)\" target=\"_blank\" rel=\"noopener noreferrer\">Rule 6.<\/a>), &#8220;an appellant may file\u00a0a supersedeas bond in the trial court in an amount equal to the judgment and costs. The supersedeas bond may be filed before or after the filing of the notice of appeal. A stay of execution ont the judgment is effective when the surety\u00a0bond is filed.\u00a0The bond\u00a0must guarantee that the appellant or a cross-appellant prosecute their appeal AND\u00a0satisfy any judgment which may be rendered against them on the appeal.&#8221; If the supersedeas bond is filed after an order of execution has been issued, then the court must immediately recall the same. In setting the bond penalty (amount) of the surety bond the courts generally follow the &#8220;judgment + costs&#8221; formula however the Rules do allow the courts some discretion. The case of <a href=\"http:\/\/www.omlaw.com\/azapp-blog\/postings\/2015\/arizona-court-of-appeals-division-one-holds-that-under-ars-12-2108-and-arcap-7-the-amount-of-a-supersedeas-bond-cannot-exceed-the-total-amount\/\" target=\"_blank\" rel=\"noopener noreferrer\">City Center Executive Plaza, LLC v. Jantzen<\/a>, is instructive. The Arizona Appeals Court found that, &#8220;Under A.R.S. \u00a7 12-2108(A) and (B), absent a finding that an appellant is intentionally dissipating assets, a supersedeas bond must be set at the lower of the \u201ctotal amount of damages awarded,\u201d fifty percent of the appellant\u2019s net worth, or $25 million. Citing extensive Arizona authority, the Court held that the term \u201cdamages\u201d does not include attorneys\u2019 fees, based on that term\u2019s \u201cpeculiar and appropriate meaning in the law.\u201d Rule 6(a)(4)\u00a0<em>Powers of the Superior Court Not Limited<\/em> further supports discretionary judicial authority by codified law.<\/p>\n<p>In conjunction with the judgment plus costs language a surety company issuing an Arizona supersedeas bond\u00a0submits itself to the jurisdiction of the trial court and appoints the court as its agent for the receipt of service of legal process. The surety may be obligated to fulfill its obligation\u00a0on motion without the necessity of an independent action.
