{"id":3140,"date":"2021-09-09T01:40:08","date_gmt":"2021-09-09T01:40:08","guid":{"rendered":"https:\/\/suretyone.com\/blog\/?p=3140"},"modified":"2021-09-09T01:40:08","modified_gmt":"2021-09-09T01:40:08","slug":"new-jersey-injunction-bond","status":"publish","type":"post","link":"https:\/\/suretyone.com\/blog\/new-jersey-injunction-bond\/","title":{"rendered":"New Jersey Injunction Bond"},"content":{"rendered":"<p>Pursuant to <a href=\"https:\/\/casetext.com\/rule\/new-jersey-rules-of-court\/new-jersey-rules-of-court\/njr-ct-part-iv\/part-iv-rules-governing-civil-practice-in-the-superior-court-tax-court-and-surrogates-courts\/rule-452-injunctions\" target=\"_blank\" rel=\"noopener noreferrer\">Rule 4:52-1<\/a>, a New Jersey injunction bond should be filed after a\u00a0complaint seeking injunctive relief,\u00a0temporary restraint or other interim relief has been granted and bond security ordered. The Rule states, &#8220;On the filing of a complaint seeking injunctive relief, the plaintiff may apply for an order requiring the defendant to show cause why the interlocutory injunction should not be granted pending the disposition of the case.&#8221; That application should be served on the enjoined party however emergencies or exigent circumstances may necessitate an ex parte motion in which case\u00a0the defendant or party injuncted is provided the opportunity to dissolve or modify the restraint upon two days&#8217; notice or on such other notice as the court fixes in the order of injunction. Meeting the &#8220;irreparable harm&#8221; threshold for obtaining TRO or injunction in New Jersey places a significant burden on the movant.\u00a0<a href=\"https:\/\/scholar.google.com\/scholar_case?case=7734617369162091086&amp;q=crowe+v+de+gioia&amp;hl=en&amp;as_sdt=4,31\" target=\"_blank\" rel=\"noopener noreferrer\">Crowe v. DeGioia, 90 N.J. 126, 132-135 (1982)<\/a> is particularly instructive.<\/p>\n<p>Rule\u00a04:52-3 states, &#8220;The court, on granting a temporary restraining order or interlocutory injunction or at any time thereafter, may require security, . . .&#8221; The &#8220;security&#8221; is a form of financial assurance, generally a New Jersey <a href=\"https:\/\/suretyone.com\/injunction-bond\" target=\"_blank\" rel=\"noopener noreferrer\">injunction bond<\/a>. This judicial surety bond is required solely at the discretion of the presiding judge.
