A Florida temporary injunction bond is required in order to perfect an injunction order in this jurisdiction. The mechanism is contemplated under Fla. R. Civ. P. 1.610<\/a>, “A temporary injunction may be granted without written or oral notice to the adverse party if;\u00a0(A) it appears from the specific facts shown by affidavit or verified pleading that immediate and irreparable injury, loss, or damage will result to the movant before the adverse party can be heard in opposition; and\u00a0(B) the movant’s attorney certifies in writing any efforts that have been made to give notice and the reasons why notice should not be required.” You observe pursuant to the statute that acceptance of a motion to enjoin is squarely within the authority of the court however, the supporting financial assurance (surety bond) is not.<\/p>\n

Pursuant to Section (b), “a\u00a0Florida temporary injunction bond must be given by the movant in an amount the court deems proper, conditioned for the payment of costs and damages sustained by the adverse party if he or she is wrongfully enjoined. Unless otherwise specified by the court, the injunction bond<\/a> must be filed within five days of entry of the order setting bond. When\u00a0the movant is\u00a0a municipality, the state or any officer, agency, or political subdivision of either\/any, then court may waive the bond requirement but conditioned in the same manner, having due regard for the public interest. No injunction bond is required upon temporary injunction that is issued solely to prevent physical injury or abuse of a natural person.<\/p>\n
