Per Chancery Court Rules, a Delaware injunction bond must be filed with the court before any restraining order or injunction will be issued. Pursuant to Rule 65, “No preliminary injunction shall be issued without notice to the adverse\u00a0party, and without a prayer included\u00a0in a verified complaint or a motion, therefore, filed\u00a0and supported by affidavit.” There are some exceptions to the general practice of Rule 65. A temporary restraining order\u00a0may be granted without written or oral notice to the adverse party or that party’s attorney only if:<\/p>\n

    \n
  1. It clearly appears from specific facts shown by affidavit or by the verified complaint that\u00a0immediate and irreparable injury, loss or damage will result to the applicant before the adverse\u00a0party or that party’s attorney can be heard in opposition, and;<\/li>\n
  2. The applicant’s attorney certifies\u00a0to the Court in writing the efforts, if any, which have been made to give the notice and the\u00a0reasons supporting the claim that notice should not be required.<\/li>\n<\/ol>\n

    Regardless of the hearing or ex parte nature of the motion to enjoin, a Delaware injunction bond must be provided. Per 65(c)<\/a>, “No restraining order or preliminary injunction shall issue except upon the\u00a0giving of security by the applicant, in such sum as the Court deems proper. The injunction bond must guarantee the payment of\u00a0such costs and damages as may be incurred or suffered by any party who is found to have been\u00a0wrongfully enjoined or restrained.\u00a0A Delaware restraining order bond (TRO bond)\u00a0given as a condition to the issuance of a\u00a0restraining order shall also constitute\u00a0surety for any preliminary injunction subsequently issued\u00a0and requiring security.” As a condition of acting as surety, the surety company<\/a>\u00a0voluntarily submits\u00a0to the jurisdiction of the Court, automatically appointing the Register in Chancery\u00a0as the surety’s agent upon whom any papers affecting the surety’s liability on the injunction bond may be served. The surety’s liability may be enforced on motion without the\u00a0necessity of an independent action by the Court.<\/p>\n
