A Missouri injunction bond and temporary restraining order bond are synonymous terms within the context of Missouri civil procedure.\u00a0Rule 92 of the Rules of Civil Procedure is the operative statute. 92-02(b)<\/a> addresses the preliminary injunction bond. No injunction or temporary restraining order, unless on final hearing or judgment\u00a0may be issued without a surety bond except in suits instituted by the state on its own behalf. The plaintiff or moving party must execute the TRO\u00a0bond with sufficient surety or sureties to the enjoined party in an amount that the court deems sufficient to secure the\u00a0movant’s obligation(s) to the\u00a0enjoined, and considering all damages that may be occasioned by the injunction or temporary restraining order. The Missouri injunction bond must be conditioned that the plaintiff will abide by the decision of the court and pay all sums of money, damages and costs that\u00a0are\u00a0adjudged if the injunction or temporary restraining order\u00a0is\u00a0dissolved.<\/p>\n

The form of the bond is very important in this\u00a0state’s courts. Precedent has created a “strict interpretation of language” treatment so the Missouri preliminary injunction bond should be prepared by a judicial bond<\/a> underwriter familiar with the case law affecting bond liability accrual.\u00a0An injunction bond that does not include the language specified in the\u00a0rule is nonetheless valid if it substantially complies with the rule’s requirements. If the terms of the bond impose conditions upon the plaintiff which are not required by the rule or which tend to undermine the protection of the defendant, such terms are void because they are contrary to\u00a0the manifest policy of the law. Thus, the bond is valid to the extent it\u00a0conforms to the essential provisions of the rule, but any additional undertaking will be stricken by the court. In Rubelman Hardware Co. v. Greve\u00a0it was argued that a bond that was intended to comply with the\u00a0injunction bond statute (which was the predecessor to the present rule) but\u00a0which failed to meet the statutory requirements was a voluntary agreement\u00a0to that extent, and would be enforceable only according to the law of contracts, subject to any express restrictions embodied in the injunction bond\u00a0statute. The court foreclosed this possibility on the ground that an extrastatutory undertaking is without any consideration cognizable at law, and\u00a0is therefore unenforceable.” (William G.
