Rule 65 is the operative statute of the injunction\/TRO mechanism and the surety bond requirements thereof. Per <a href=\"https:\/\/www.ncleg.gov\/EnactedLegislation\/Statutes\/PDF\/BySection\/Chapter_1A\/GS_1A-1,_Rule_65.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Rule 65.(c)<\/a>, &#8220;No restraining order or preliminary injunction shall issue except upon\u00a0the giving of security by the applicant, in such sum as the judge deems proper. The North Carolina injunction bond must guarantee the payment\u00a0of such costs and damages as may be incurred or suffered by any party who is found to have\u00a0been wrongfully enjoined or restrained. The State of North\u00a0Carolina or of any county or municipality thereof, or any officer or agency thereof acting in an\u00a0official capacity are parties that are exempt from the North Carolina temporary restraining order bond requirement however damages may be awarded against\u00a0government parties pursuant to this same rule. In\u00a0suits between spouses relating to support, alimony, custody of children, separation, divorce\u00a0from bed and board, and absolute divorce\u00a0an injunction bond will not be\u00a0required of the plaintiff\u00a0spouse as a condition precedent to the issuing of a temporary restraining order or preliminary\u00a0injunction enjoining the defendant spouse from interfering with, threatening, or in any way\u00a0molesting the plaintiff spouse during the pendency of the suit\u00a0subject to any modifying order(s) of the court. Damages may be awarded against the party seeking injunction pursuant to this statute.<\/p>\n<p>In North Carolina, civil procedure also addresses the injunction bond requirements when a court vacates or denies a motion to restrain or enjoin.\u00a0<a href=\"https:\/\/www.ncleg.net\/EnactedLegislation\/Statutes\/PDF\/ByArticle\/Chapter_1\/Article_37.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">\u00a71-500<\/a> states, &#8220;Whenever a plaintiff\u00a0appeals a judgment vacating a restraining order previously\u00a0granted, or denying a perpetual injunction in any case\u00a0where such injunction is the principal relief sought by the plaintiff, and where it shall appear that\u00a0vacating the restraining order or denying injunction will enable the defendant(s) to accomplish the threatened act that the plaintiff sought to restrain before an appeal can be heard so that the plaintiff will\u00a0be deprived of the benefit of any judgment of the appellate division reversing the\u00a0judgment of the lower court, then the original restraining order granted in the case may within the discretion of the\u00a0trial judge remain in effect during the pendency of the appeal\u00a0PROVIDED that\u00a0the plaintiff files an injuction bond (&#8220;indemnifying bond&#8221; per statute) with sufficient surety, approved by the clerk or judge, in an amount to\u00a0indemnify the enjoined\u00a0 party against all loss\u00a0up to the penal sum of the North Carolina injuction bond, which he or she may suffer on account of continuing restraint in\u00a0the event that the judgment of the lower court is affirmed by the appellate division.
