A California home care organization dishonesty bond is required of all candidates that submit a license request to the California Health and Human Services Agency (CDSS). Per the Department, the regulatory framework establishes a program that, "promotes consumer protection for elderly and disabled individuals who hire private aides to come into their homes and provide assistance with activities of daily living." The surety bond is a financial assurance mechanism that guarantees compliance with a HCO's responsibilities to those for whom care is provided and to the state agency administrating the program.

The California home care organization employee dishonesty bond must be written in the amount of ten thousand dollars ($10,000). The surety obligation runs to any client(s) that suffer damages fro any dishonest or fraudulent act, including but not limited to theft, embezzlement, conversion or common law fraud or deceit by the licensee and his or her employees. Clients damaged as a result of the dishonest or fraudulent acts of the of the HCO may file a claim with the surety directly or bring suit in a court of competent jurisdiction.
