California Talent Agency Bond

A California talent agency bond is required by the Department of Industrial Relations, along with other application materials before a person or firm may operate a talent agency. Per the Labor Code section 1700.4(a)), "Talent agency" means a person or corporation who engages in the occupation of procuring, offering, promising, or attempting to procure employment or engagements for an artist or artists, except that the activities of procuring, offering, or promising to procure recording contracts for an artist or artists shall not of itself subject a person or corporation to regulation and licensing under this chapter. Talent agencies may, in addition, counsel or direct artists in the development of their professional careers. No person may engage in or carry on the occupation of a talent agency without first procuring a license therefor from the Labor Commissioner." The California talent agency bond must be issued by a surety company licensed to do business in the state in the amount of fifty thousand dollars ($50,000). The surety bond guarantees compliance with the Labor Code Section 1700.16, i.e., pay all sums due any individual or group of individuals when the talent agency licensee or his or her representative or agent has received such sums, pays all damages occasioned to any person by reason of misstatement, misrepresentation, fraud, deceit, or any unlawful acts or omissions of the licensee or of his or her agents or employees.
