Unfortunately, family separation and the resultant controversy between domestic partners of the custody and care of partners' children is too common. Where a custodial partner has well-founded concerns about the return of a minor child by the non-custodial parent, a court may determine that an order in insufficient and order that financial assurance be offered to secure the child's return. The most common form of guarantee for court obligations is a child custody bond.

A child custody bond is most often required when a parent is a foreign national and/or intends to travel to a location outside of the court's jurisdiction. The Uniform Child Custody Act, adopted nationally provides strong mechanisms to compel return of a minor child, by seizure if necessary. Outside of the United States the UCCA has no binding effect, leaving the custodial parent without any remedy or recourse in the case of a parental kidnapping. Generally a child custody bond guarantees solely return of the child to the custodial parent pursuant to a specific schedule or on a specific date however because the non-custodial parent has obligations to the child's safety and welfare the surety bond can be construed to require performance of those obligations and/or avoidance of certain persons, places or things that endanger the child.

A child custody bond must be issued by a surety company with a certificate of authority in the "home state" of the child, or be qualified to undertake surety obligations in the jurisdiction from which the order is emitted.
