Per the Florida Department of Agriculture and Consumer Services (FDACS), "A game promotions that offers a prize totaling more than $5,000 must file with the Department a registrations package no less than seven (7) days prior to commencement of the game or sweepstake and delivery a Florida game promotion bond on the state-approved form." The surety bond requirement MAY be waived if the game promoter has conducted promotions in the state for at least five consecutive years and that promoter has had no civil, criminal or administrative actions instituted against him or her for a violation of Section F.S. 849.094 during that five-year period.
The Florida game promotion bond must be written in an amount equal to no less than the total value of all prizes offered and filed with the Department at least seven (7) days prior to the game promotion. The surety bond must accompany the state's game of chance filing packet. The Department retains a certified list of winners provided by the game promoter for a period of at least six (6) months after receipt of the list, at which time the principal and surety may be released. The bond is both a statutory compliance obligation and a financial guarantee of the prize payment or delivery. Violations can result in fines of $1,000 per act which is taxable against the bond even if prize winners are satisfied.
