Florida Code requires any person or business who is a seller or promoter of travel related services to register annually with the Department of Consumer Services. Unless exempt, sellers of travel are required to provide proof of assurance in the form of Florida seller of travel bond in an amount not to exceed $25,000, or a $50,000 surety bond if vacation certificates are sold. The bond is a strict guarantee that the seller will provide the services (travel package) contracted for. Multiple breaches and/or complaints can quickly cause losses to accumulate, which makes this bond unattractive to many surety companies.

The Florida seller of travel surety bond is required by all registrants unless the the applicant falls under the Airline Reporting Corporation (ARC) exemption AND the Florida Department of Agriculture and Consumer Services (FDACS) has approved an exemption. The FDACS may allow a registrant to post a lesser amount however the general rules are:

  • Sellers that DO NOT offer vacation certificates must submit a $25,000 seller of travel bond.
  • A seller of travel that DOES offer vacation certificates must submit a $50,000 seller of travel bond.

The commercial surety bond class is made up of simple, transactional bonds that do NOT contain contract performance guarantees. License and permit bonds, public official bonds, court bonds and miscellaneous surety bonds are the major categories of this class. A seller of travel bond requires only a completed application to underwrite unless the operator has filed bankruptcy or had regulatory action taken against him/her by the Florida Department of Agriculture and Consumer Services. Commercial surety bonds are essentially unsecured credit instruments therefore personal credit is an important factor in certain underwriting and rating decisions.
