Pursuant to Maryland Criminal Procedure Article §10-221 and CJIS Rules an individual or firm may operate a LiveScan fingerprint service if the applicant enters in to an approved agreement with the state and files a Maryland private finger printing provider surety bond. The Department of Public Safety and Correctional Services may certify private providers to submit electronic fingerprint information directly to the Criminal Justice Information System (CJIS) for the purpose of obtaining background checks on behalf of private parties. The private provider charges fees for his or her services.
The surety bond must be issued in the amount of ten thousand dollars ($10,000) by surety company licensed to issued insurance in the State of Maryland. The obligation is a guarantee that the operator will honestly conduct all the services and duties of a private provider as outlined in a "Private Provider Agreement". The surety is also obligated to pay DPSCS all monies owed by the operator for providing the services outlined in the agreement within thirty (30) days of written notice. The private finger printing provider bond runs concurrent with the authorization certificate issued by the state and may be renewed every three (3) years by continuation certificate.
