A Minnesota PCA agency surety bond is required by the Minnesota Department of Human Services before a license candidate may begin operations that involve Medicaid billing. The division of Minnesota Health Care Programs (MHCP) requires specific insurance coverages, a fidelity bond in the amount of no less than $20,000 and the PCA agency bond. The surety bond penalty follows a specific agency formula.

  • A PCA agency bond in the amount of fifty thousand dollars ($50,000) for initial enrollment of service providers.
  • A $50,000 bond upon annual revalidation IF the PCA received $300,000 or less in Medicaid payments.
  • A surety bond in the amount of $100,000 if the PCA received Medicaid payments in excess of $300,000.

The Minnesota personal care assistant agency surety bond is a statutory compliance obligation however a review of the bond's purpose and the underlying statute (Minnesota Statutes, Section 256B.0659, Subd. 21(a)(2)) is instructive. The bond form guarantees that the licensee will, "secure the compliance by the PCA agency with the terms of Minnesota Statute, Chapter 256B, of all rules made by the Commissioner, and any other legal obligations arising out of the licensee’s conduct as a personal care assistance provider agency." The PCA agency bond is a fixed penalty obligation however its sufficiency is reviewed and the surety bond amount adjusted per the Medicaid billing results.
