Montana Title Bond

A lost or defective motor vehicle title can be bonded for automobiles with a value in excess of $500. A Montana title bond is a simple, quick solution for clearing the ownership record. Per MT 61-3-208, "If application is being made for a motor vehicle, trailer, semitrailer, or pole trailer with a value that exceeds $500, the applicant shall provide a bond, in a form prescribed by the department, issued by a surety company authorized to do business in Montana."

A Montana certificate of title bond may be used for registration of motor vehicles, trailers, semitrailers, or pole trailers. The bond must be issued in an amount equal to the retail value of the vehicle. For purposes of determining value, the Motor Vehicle Division (MT MVD) will accept a copy of the NADA guide showing the same. The title bond indemnifies any prior owner, lienholder, subsequent purchaser, secured creditor, or encumbrancer of the vehicle against expenses, losses, or damages, including reasonable attorney fees, caused by the issuance of the certificate of title. The surety bond must be submitted to the MVD with proof of ownership such as a notarized bill-of-sale, cleared check or invoice, a vehicle identification number Inspection Certificate (form MV20) completed by a law enforcement agency and the state's specific application for a bonded title (form MV10). As part of the certificate of title bond underwriting process we must request some evidence that the applicant legally possesses the motor vehicle. Examples of "ownership evidence" can be a bill of sale, power of attorney, receipt, canceled check or money order, temporary registration/maker, affidavit of legal possession or endorsed copy of at title.
