Independent adjusters must be licensed by the Department of Financial Services. Pursuant to N.Y. ISC. LAW § 2108 (Adjusters; licensing and duties), an applicant must pass a licensing examination, evidence experience as an adjuster or submit a certificate of prelicensing education, and provide a New York independent adjuster bond. The surety bond must be issued in the amount of one thousand dollars ($1,000) and be valid until December 31st, of the two year "rotating" license term. The obligation is a compliance guarantee of the adjuster's faithful performance or his or her duties. The bond form states that the State may recover from the bond any amount necessary up to the full surety bond penalty if the adjuster, or any sub-licensee is found guilty of fraudulent or dishonest practices in connection with the transaction of his or her business as an independent adjuster during the license period for which the New York independent adjuster bond is issued or if he or she is convicted been under any of the Sections contained in Article 150 of the Penal Law for an offense or offenses committed during such license period.
