The San Diego Environmental Services Department regulates the use of its landfill. Permits of use include a requirement that an operator file a deferred payment account bond. Per the City's website, "the City of San Diego's Environmental Services (ESD) offers payment through Deferred Payments Account (DPA) services. This service is available to landfill customers who use the Miramar Landfill regularly, prefer not to pay by cash or check on each visit, and maintain a minimum usage two hundred fifty dollars ($250) over a three month period. An Outgoing Materials Deferred Payment Account (OMDPA) is offered for landfill customers who purchase large volumes of mulch, compost, woodchips or other landfill products." Failure to maintain a dump bond with the city DPA will terminate the operator's use of the facility under deferred payment terms.
The San Diego deferred payment account bond guarantees that the user will comply with all applicable provisions of law and the San Diego Municipal Code governing Deferred Payment Accounts, and makes payments to the City of San Diego according to the terms of each invoice billed within seventeen (17) days from the date of invoice mailing. The surety bond must be continuous in form. The City will notify the surety of default on the user's agreement and allow the surety fourteen (14) days to comply with the requirements of the surety bond's terms.
