A Virginia household goods carrier bond is one of the statutory requirements of candidates for a carrier license. V.A.C. defines a household goods carrier as a person (business) that transports, "personal effects and property used or to be used in a dwelling, when transported or arranged to be transported (i) between residences or (ii) between a residence and a storage facility with the intent to later transport to a residence. Transportation of such goods must be arranged and paid for by, or on behalf of, the householder." There are no legal exceptions if the operators receives remuneration for carriage or brokering carriage.
The Virginia household goods carrier surety bond must be issued in the amount of fifty thousand dollars ($50,000) and filed with the Commissioner of the Department of Motor Vehicles, Carrier Division. The surety's obligation is to guarantee that the license operator will, "faithfully comply with the requirements of law, save and keep harmless any person from any fraud practiced on him or her, or fraudulent representation made to any client by the license or his/her representatives within the scope of employment, or from any loss or damage suffered by reason of the violation of an of the provisions of Chapter 21, Title 46.2 of the Code of Virginia". The bond contains a cancellation provision however the VA DMV's directive states, "You must keep a $50,000 surety bond or letter of credit on file with DMV's Motor Carrier Services for five years from the date your operating authority certificate is issued.", which creates a potentially significant tail to the obligation. A license candidate should be knowledgeable of not only the VACs but also the administratively promulgated rules and requirement of operators.
