Bond Penalty: Based on Gross Payroll, Minimum $8,000

A Wyoming non-resident employers' bond is required from business that are domiciled outside of the state. Pursuant to Wyoming Statutes Title 27. Labor and Employment §27-1-106, non-resident businesses "of any kind that expect to pay wages in the state of Wyoming in excess of ten thousand dollars ($10,000.00) monthly or one hundred twenty thousand dollars ($120,000.00) annually as a result of Wyoming operations, must file with the Director of the Department of Workforce Services a surety bond approved by the director and the attorney general."

The non-resident employer's bond must be written in the amount of twenty thousand dollars ($20,000.00) plus an additional two thousand dollars ($2,000.00) for each one hundred twenty thousand dollars ($120,000.00) or fraction thereof , of the wages expected to exceed one hundred twenty thousand dollars ($120,000.00) annually. The obligation is specific, guaranteeing the following:

  • The payment of wages of employees working in the state;
  • The payment of civil penalties the occupational health and safety commission may assess; and
  • All other payments or obligations of the nonresident employer required by the Wyoming Worker's Compensation Act unless waived by the director pursuant to W.S. 27-14-302, and any other section under title 27 of Wyoming statutes or any department of workforce services rule or regulation.

The surety bond contains specific forfeiture provisions and conditions under which the bond may be withdrawn or canceled. It is a financial guarantee in addition to a license compliance obligations and runs by its language to OSHA as well as the workforce division. The surety bond continues for a minimum of two years.
