According to the Surety & Fidelity Association of America, an Alabama Waste Treatment Surety Bond is a proposed requirement for certain treatment facilities as part of the permitting requirements. Waste treatment facilities that accept and process “industrial waste” may be forced to offer the industrial waste treatment bond in an amount and under terms set by the Department of Environmental Management. Industrial waste includes, “solid waste generated by manufacturing or industrial processes that is not a hazardous waste regulated under Chapters 22 to 30, inclusive, of Title 22, Code of Alabama 1975, and the state regulations promulgated thereunder.” Much like a standard landfill (closure and/or post-closure bond), the “financial assurance” would have to be sufficient to ensure proper run-off if the treatment facility closed, abandoned or failed in its statutory maintenance requirements pursuant to the permit.
