Pursuant to the New Jersey State Board of Examiners of Heating, Ventilating, Air Conditioning and Refrigeration (HVACR) Contractors a New Jersey HVAC Contractor surety bond is now required of new applicants for a license. As published by the Board, “Regulations implementing N.J.S.A. 45:16A-1 et seq., the “State Heating, Ventilating, Air Conditioning, and Refrigeration Contracting License Law” (Act) were published on April 15, 2013 at 45 N.J.R. 910(a). The operative date for these regulations was established as October 15, 2011, later extended to March 1, 2014, in order to allow time to develop a licensing examination.  The law includes a provision, N.J.S.A. 45:16A-26, that authorizes the Board to issue a Master HVACR license based on experience without examination for six months. This six-month “grandfathering” period, during which individuals currently practicing as HVACR contractors may submit an application for licensure without meeting education or examination requirements, begins on March 1, 2014 and ends on September 1, 2014.”  One of the provisions of the new law requires the posting of a New Jersey HVAC Contractor surety bond.

Pursuant to 45:16A-23, . . . no Master HVACR contractor licensed under this act shall undertake to do any HVACR work in the State unless and until he shall have first entered into a surety bond in favor of the State of New Jersey in the sum of $3,000 executed by a surety company authorized to transact business in this State, approved by the Department of Banking and Insurance and to be conditioned on the faithful performance of the provisions of this act. No municipality shall require any similar bond from any Master HVACR contractor licensed under this act. The board shall by rule and regulation provide who shall be eligible to receive the financial protection afforded by the bond required to be filed by this section. The New Jersey HVAC surety bond shall be for the term of 12 months and shall be renewed at each expiration for a similar period.
