An individual or that wishes to operate in the State of Pennsylvania as a title agent must be licensed and provide a Pennsylvania title agent bond. The Pennsylvania Insurance Department is the licensing and regulatory authority overseeing title agents. The Department requires a surety bond pursuant to 40 P.S. 910-26.1(3) in an amount of no less than $100,000. If the title agent also has employees, then he or she must also obtain a blanket fidelity bond covering all agency employees in the amount of no less than $150,000 with a deductible of no greater than fifteen percent of the bond penalty must be obtained. The Pennsylvania title agent surety bond guarantees that the licensee will fully and faithfully observe and comply with the terms and provisions of P.L.682, Act 79 of 1995, Section 726.1, of the Commonwealth of Pennsylvania, and shall satisfy any judgment rendered against them for violation of such statute.
