A Wisconsin employment agency bond is required by state statute from ONE of two classes of agency license. Wisconsin §105.01 defines “employment agent” as any person who furnishes to others seeking employment, information enabling or tending to enable such persons to secure the same, or who furnishes employers seeking laborers or other help of any kind, information enabling or tending to enable such employers to secure such help, or who keeps a record of persons seeking employment. The Wisconsin employment agent bond is not required from employment agencies that charge fees to BUSINESSES seeking workers. The surety bond must be written in the amount of $5,000 and issued by a surety company licensed to do business in Wisconsin. The Division must review and approve the instrument. The obligation guarantees that the agent will conform to and not violate any of the duties, terms, conditions or requirements of Section 105.01 to 105.16 inclusive of the Wisconsin Statutes, and any rules issued by the Division. The Wisconsin employment agents bond is cancelable by surety upon sixty days written notice. There is no indication that the obligation or the underlying statute creates cumulative liability, mandatory forfeiture or any other onerous condition.
